Our user agreement consists of these General Terms and Conditions of Business GTC and our Privacy Statement in accordance with the General Data Protection Regulation (EU), which came into force in May 2018.
The Privacy Statement applies to those who live in Switzerland, Liechtenstein or the European Union and make use of our services.
General Terms and Conditions of Business GTC
of Silke Schäfer Online GmbH and Silke Schäfer Coaching & Event GmbH
These general terms and conditions of business (GTC) apply to all activities of Silke Schäfer Online GmbH and Silke Schäfer Coaching & Event GmbH (“we” or “us”). The GTC apply, in particular, to all services and products (together “services”) purchased or booked through our website www.silkeschaefer.com ("Website").
In these GTC we will address you directly with “you”, “yourself” etc. respectively. Addressed are thereby all persons that use our website in any way and/or receive our services or enter a contractual relationship with us in any other way.
By using our website, especially for the purchase of our services, you agree to be bound by these GTC. Before using our services or placing an order you should have read and understood the terms and conditions. When using some of our services you may be asked to repeat your agreement to be bound by these GTC by clicking on a confirmation box.
The processing of personal data is governed by our privacy statement. The privacy statement is an integral and binding part of these GTC.
The purchase of our services requires a registration. The registration occurs by opening a personal user account and is free. If you do not yet have a user account, you will be asked to register with the required information when making a first purchase.
Aside from legal persons, registration is open only to natural persons fully capable of acting and of age (i.e. at least 18 years old). You are obliged to state the information required for registration truthfully and completely. In case of changes the information must be updated immediately so that the user account information is always complete and correct. Incomplete registrations will be deleted without notice after a reasonable time.
The login data designated during the registration process, like usernames, email address and password are for your personal use and you are responsible for keeping it confidential. All purchases made through your user account are attributed to you and are binding for you.
We reserve the right to delete personal data or lock your user account at our own discretion at all times.
3. Conclusion of Contract
The overview of our services and prices provided on the website or other sales channels shall merely be considered an invitation to you to place an offer. You will make your choice via the sales channel. The choice made will be shown in the shopping cart (web shop) or communicated to you by telephone or email. When you confirm the order by clicking the appropriate confirmation box (“Bestellung abschliessen”) in the web shop or by verbal confirmation on the telephone or written confirmation by email, you submit a binding offer to purchase the chosen service. The purchase agreement regarding the services we offer is concluded when we have confirmed your purchase via our website, by telephone or email. Confirmations sent to possibly misstated email addresses count as legally valid. If we do not confirm an order immediately, you will remain bound to your offer for two days.
Depending on the type of the services selected your contractual partner is either Silke Schäfer Online GmbH or Silke Schäfer Coaching & Event GmbH.
When ordering by phone you can view these GTC beforehand on our website. Phone orders come about only on the basis of these GTC, which are deemed accepted upon ordering.
4. Services and Prices
We offer various fee-based services in the field of astrology, meditation, and wisdom training through our website.
For all these services our conditions, made available through the website and other sales channels, apply. We reserve the right to change the services offered at any time or end the delivery of services.
We divide our services in "digital products" (PDF, mp3, videos, digital subscriptions and community access) that are offered by Silke Schäfer Online GmbH and in "products" (meditation events, talks, events, workshops, subscriptions to meditations events and wisdom trainings) that are offered by Silke Schäfer Coaching & Event GmbH.
In addition to these two product categories we offer access to our password-protected community platform in the form of memberships (“community access”). The memberships include the free use of a broad selection of defined digital products. You can choose between memberships of different duration and a trial subscription.
4.2: Information about digital products and community access
The Sternen-News newsletter and the monthly videos can be purchased both individually and as part of different subscriptions with a different number of issues or different terms of validity respectively.
All digital subscriptions as well as access to the community end after the intended term of validity expires. There is no automatic renewal.
The forwarding of digital products to or the sharing of login data for the community with people not living in the same household (“external parties”) is not allowed.
The unauthorized forwarding of digital products or sharing of login data for the community to external parties is considered data abuse. In these cases, we reserve the right to charge you for the full price of the digital product concerned to the extent it has been forwarded and to block access to the customer account without compensation.
No rights of reproduction or publication (like the right to make copies that are not for personal use, the execution of digitalisation processes, performance or publication rights etc.) are granted to you with the sale of the digital products. Reproduction or publication of the products (even in part or in extracts) is not allowed and breaches copyright law.
4.3: Information about non-digital products
For Full Moon Meditation events individual admission tickets as well as a subscription comprising six admission tickets can be purchased. The subscription is valid for two years, during this time all tickets must be redeemed. Admission tickets that have not been redeemed will become invalid after the end of the subscription period. Every redeemed ticket reduces the subscription by one ticket.
Admission tickets for workshops/events/talks/trainings can be purchased through the website’s web shop. Purchased tickets cannot be returned. Moreover, they must not be reproduced, copied, or printed multiple times.
5. Prices and Terms of Payment
We offer various payment methods for orders made through our website. Payment is made:
a) by debiting the credit card (Eurocard/MasterCard, Visa, American Express) specified during ordering or saved in your customer account, by PostFinance, by advance payment, or by instant transfer (e-banking).
b) In case of advance payment, the payment is due within five working days from the order date. The date of the payment transaction determines the keeping of the term.
It is our choice which forms of payment are accepted and whether/when bookings that have not been paid for in time will be released for sale again.
All bank charges incurred in the process of payment are to be paid by you. You must ensure that the full purchase price is credited to our account when paying by bank transfer. If the full purchase price is not credited to our account, the selected product is deemed to have not been paid.
When purchasing admission tickets for events cash payments may be possible in addition to online ticketing – if tickets are still available at the door. The prices can differ from the prices published on our website. These tickets cannot be reserved.
A claim to the purchased product arises only when the purchase price has been paid in full (crediting of the corresponding amount to our account or confirmation of payment by the provider of the respective payment system). We reserve the right to withhold products until payment has been made in full.
5.5: The full payment of workshops/trainings must be made in accordance with the payment target stated on the invoice. The payment target is binding. Non-payment of the workshop/training fee in accordance with the payment target is considered as cancellation with costs to be born by you.
5.6: The full payment for talks is made electronically through our website and invoiced by a third-party supplier. Your participation is definite and binding from the moment of registration. Purchased and reserved tickets cannot be returned and must be paid in due time. They must not be reproduced, copied or printed multiple times.
For clients outside of Switzerland: Prepayment for a counselling appointment by Zoom or telephone must be made as per term of payment stated on the invoice. If payment is not made in due time the appointment will automatically be cancelled and released for booking again.
Your personal data is the foundation for any statements by Silke Schäfer. The responsibility for the correct transmission of these sensitive data items lies fully with you.
Personal decisions based on our oral or written astrological interpretations are fully within the responsibility of the person concerned. Any claims are excluded. Any liability relating to this is excluded.
Above all else we do not assume liability for success or rather do not guarantee a successful counselling outcome.6.3:
Naturally we make every effort to ensure the proper implementation of workshops/events/talks/trainings. However, the use of event facilities and of any services is solely at the participants own risk. Any liability is excluded to the extent permitted by law. Furthermore, we do not accept liability for any valuables brought, neither regarding theft nor loss.
Subject to your rights expressly stated in these GTC, all claims (especially claims for damages, claims due to delivery delays, retention of the purchase price, compensation for lost profit, reduction, cancellation of the contract or withdrawal from the contract) against us and our helpers and auxiliary persons are excluded independent of legal cause and to the extent permitted by law. We do not accept any liability for consequential damage arising from the use of our products. In any event any claim of liability exceeding the value of the order is excluded.
We cannot accept liability for the security and protection of data transmitted via the internet and for the completeness and correctness of the content of our website. In particular we do not accept liability for direct or indirect damage and consequential damage caused to users of the website.
Links, hyperlinks or web addresses that link from our website to one or several other websites serve exclusively to inform the clients. The relevant websites are independent from us. We do not give assurances related to other websites and do not accept any and all liability related to other websites.
7. Right of Cancellation
Orders are binding and may only be cancelled or changed with our written permission. Costs arising from cancellation or change and/or processing charges will be deduced on principle.
Regarding our digital products (PDF, mp3, videos, digital subscriptions and community access) and our other products (meditations, talks, events, workshops, subscriptions to meditations and wisdom trainings) there is no right of cancellation.
8. Terms and Cancellation Policy
Appointments for personal consultations can be made only by Community Full Members and through the online calendar ( Online-Agenda )
If booking a couples consultation one of the two persons must be member of the community with a valid 6-month- or 12-month-membership.
A community membership (6 months / 12 months) is a precondition but not a binding guarantee for an appointment.
Open appointments will be announced in the community on the BLOG.
The online calender is provided by us and linked to the shop. After successfully booking an appointment you will receive a confirmation by email. All relevant information about the booking, the Zoom and a link to change or annul your booking will be made available in your customer account (Kundenkonto) under "Termine mit Silke".
Appointments for anyone who is 18 years old or older are linked to a personal and individual customer account. Data about children and adolescents up to 17 years of age will be stored in the customer account of the mother or father and is subject to parental responsibility.
We regard the person booking the consultation through our website as our contractual partner. This person is fully responsible for the correct collection of their sensitive data items.
Consultations for children under and up to 13 years old are part of a consultation with the mother and/or father and are charged as a regular consultation (fee for individual consulations).
For personal conversations with adolescents between 14 and 17 years of age (vocation/career questions) we offer a reduced fee of 50% of the regular consultation fee. For personal conversations with students we offer a reduced fee of 40% of the regular consultation fee. A valid student ID must be presented when booking the appointment. The discounts will be refunded by our accounting department three days after the consultation at the latest and in the same way they have been paid. The flat fee for administrative costs is excluded from the discount.
If you have successfully booked an appointment, if will be confirmed immediately after booking in your customer account under “Termine mit Silke”. The booking will also be confirmed by an email to the email address associated with your customer account and is deemed to have been legally delivered to the person making the booking.
8.1.7: The simultaneous booking of several consultation appointments by and for the same person is not allowed. In that case Silke Schäfer Coaching & Event GmbH reserves the right to release the additional appointments for renewed booking. You will be notified about the cancellations by email. The appointments will remain visible in your customer account with a note stating “Von Silke storniert” (cancelled by Silke).
8.1.8: You cannot book appointments for other persons through your own customer account. Exception: Your own children. Silke Schäfer Coaching & Event GmbH reserves the right to release all booked appointments for renewed booking in cases of uncertainty, especially if there are several bookings for different persons. You will be notified about the cancellations by email. The appointments will remain visible in your customer account with a note stating “Von Silke storniert” (cancelled by Silke).
Every booking through the online booking system automatically requires payment. We accept credits cards but no advance payment.
You can change or cancel booked consultations through our online calendar. We also accept cancellations by email. The link for changes and the link for cancellations are in your customer account under “Termine mit Silke”.
Booked appointments can be cancelled by Silke Schäfer Coaching & Event GmbH without explanation at any time. You are not entitled to an alternate appointment. All costs will be refunded. You will be notified of the cancellation by email. The appointment will remain visible in your customer account with a note stating “Von Silke storniert” (cancelled by Silke).
Cancellation by you up to 24 hours before the scheduled appointment is free of charge and the prepaid consultation fee will be refunded. The administrative fees will not be refunded.
In case of cancellation within 24 hours or of non-attendance the full prepaid consultation fee will be kept by us.
Refunds will be made three working days (Monday to Friday) after the consultation appointment at the latest and in the same way they have been received.
8.1.13: For consultations by Zoom you can access the virtual consultation room with the Zoom-link in your customer account under “Termine mit Silke “ (appointments with Silke). Please download the current Zoom-App to your computer with plenty of time to prepare and ensure that your microphone and camera are enabled.
For consultations by telephone we will expect your call at the telephone number shown in your customer account under “Termine mit Silke” (appointments with Silke).
If you arrive late for the scheduled consultation you are not entitled to an extension of the consultation time.
8.1.15: All consultations via Zoom will be recorded by Silke Schäfer Coaching & Event GmbH and made available to you free of charge. The video recording is supplied without liability. We do not accept any liability or guarantee for faulty recordings.
All consultations via telephone or live and in person will not be recorded by Silke Schäfer Coaching & Event GmbH . We recommend making your own recording of the consultation, for example with a smartphone app.
After the consulation all generated documents and the Zoom-recording will be uploaded to your customer account by Silke Schäfer Coaching & Event GmbH at "Termine mit Silke" . They are available for downloading for 30 days, after this time they will be deleted for reasons of data protection. You will receive an email reminder three days before deletion of the files. The date of the upload and deletion are noted in your customer account.
8.2: Sternen-News subscriptions
8.2.1: Digital 12- and 6-issue-subscriptions of the Sternen-News newsletter cannot be terminated and end automatically upon expiry of the subscription period. They do not renew automatically. Furthermore, there is no right of cancellation.
8.2.2: Subscriptions for the Sternen-News by mail can always be cancelled in writing with one month’s notice to the end of the month.
8.2.3: We reserve the right to suspend delivery immediately without giving any reasons if payment is not made in due time.
8.2.4: If the production of the Sternen-News is discontinued before expiry of the purchased subscription period, we will refund the relevant partial amount for the cancelled subscription period. In the event of the author’s death you are not entitled to a refund.
8.3.1: Bookings for talks/events/meditations offered by Silke Schäfer Coaching & Event GmbH are binding upon completion of the order. Purchased and reserved tickets cannot be returned. There is no right to cancellation.
8.3.2: Bookings for talks/events/meditations must be paid in advance via our website by means of one of the payment methods offered. Before the payment has been credited to our account no right of participation in the event exists. One admission ticket entitles one person to participation in the booked event.
8.3.3: Admission tickets must not be reproduced, copied or printed multiple times. Bookings that have already been paid will not be refunded.
8.3.4: If places are still available, admission tickets can be purchased at the door. These must be paid in cash before the start of the event.
8.3.5: Silke Schäfer Coaching & Event GmbH reserves the right to cancel talks or meditations in case of illness or unforeseeable events, also at short notice. Participants will be informed about the cancellation as quickly as possible by email or text message. In case of cancellation of an event, payment made for the ticket will be fully refunded. Possible further claims, especially for interest or damages, are excluded.
8.4: Meditation subscriptions
8.4.1: Meditation events are also available by subscription. These subscriptions are made out to you personally and are not transferrable.
8.4.2: The subscriptions automatically expire after their validity date and cannot be set off or exchanged against any of our other products.
8.5.1: Bookings for workshops/trainings offered by Silke Schäfer Coaching & Event GmbH are binding upon completion of the order. There is no right of cancellation.
8.5.2: The smooth implementation of a successful workshop/training is based on correct personal information (birthday, place of birth, time of birth) of the participants. Please send us the necessary information no later than three weeks before the start of the workshop. If you submit these dates at a later time, we reserve the right to neither hand out relevant papers nor to elaborate on the horoscope during the workshop.
8.5.3: You may withdraw from a workshop/training. Withdrawal from a workshop must be declared in writing (by post or email) to Silke Schäfer Coaching & Event GmbH.
8.5.4: If notice of the withdrawal is given up to three weeks before the date of the event, only a compounded cancellation fee of 10% of the fee for the booking is charged and deducted from the refundable amount before the refund is given. In case of withdrawal at a later date – that is within the three weeks before the date of the event – the complete fee will be charged and no refund of already paid bookings will be made. In case of illness or accident a refund of the full fee is given only upon presentation of a medical certificate.
8.5.5: If participants are unable to participate in a workshop/training they have the possibility to find a replacement. The replacement person must be registered in writing, stating name/first name and email address of the replacement.
8.5.6: Silke Schäfer Coaching & Event GmbH reserves the right to cancel a workshop in case of illness or unforeseeable events, also at short notice. Participants will be informed about the cancellation as quickly as possible by email or text message. In case of cancellation of an event, payment made for admission will be fully refunded. Possible further claims, especially for interest or damages, are excluded.
8.5.7: To run our events under the best possible conditions we specify a minimum and maximum number of participants dependent on the event. As a rule, the event will be cancelled in case of an insufficient number of participants and paid fees will be refunded. Possible further claims, especially for interest or damages, are excluded.
8.5.8: Should a participant violate the provisions of copyright law as it is currently valid or act in a clear, obvious, and intentional way that indicates a copyright violation, the participant will be excluded immediately from the workshop due to this legal violation after Silke Schäfer Coaching & Event GmbH has obtained knowledge of it. In this case the right to a refund is lost.
We take pictures and make videos or audio recordings at our events on a regular basis, including those in which participants can be recognised. The relevant pictures/videos/audio recordings are published on our website and on social media for advertising purposes.
9.1: By participating in an event, you declare that you consent to the publication of possible pictures in which you may be recognized. You can withdraw your consent at any time and demand that we remove pictures in which you can be recognized after possible publication and stop using them. Any claims for compensation in this context cannot be asserted.
9.2: During some of our events there will be filming. If there is filming during events this will be communicated in advance. By participating in an event, you declare that you consent to the publication of possible videos in which you may be recognized. You are transferring all necessary rights in this context to us. If you do not wish to be in the video, you are required to inform us at the beginning of the event at the latest.
9.3: Independent video or audio recording of our events is not permitted. The pictures/videos/audio-recordings published by us are protected by copyright. The distribution, reproduction or editing of these pictures/videos/audio-recordings without our prior written permission is prohibited.
The website as well as all content accessible via the website are protected by copyright and belong exclusively and fully to Silke Schäfer Coaching & Event GmbH and/or Silke Schäfer Online GmbH.
The (complete or partial) reproduction, distribution, transmission (electronically or by other means), modification, linking or use of the contents for public or commercial purposes without our prior written permission is prohibited. We reserve the right to block access to the customer account without compensation in the case of such misuse of data.
11. Place of fulfilment, place of jurisdiction and applicable law
11.1: The registered office of Silke Schäfer Coaching & Event GmbH and/or Silke Schäfer Online GmbH is agreed as the place of performance for all our services. The place of performance is therefore Meilen/Zurich, Switzerland.
11.2: For these GTC and possible disputes arising from or in the context of the relationship between Silke Schäfer Coaching & Event GmbH and Silke Schäfer Online GmbH and you, Swiss law shall be exclusively applicable, excluding the conflict of laws provisions and the provisions of the UN Sales Convention (CISG).
11.3: The exclusive place of jurisdiction for all disputes between Silke Schäfer Coaching & Event GmbH and/or Silke Schäfer Online GmbH and you is the registered office of Silke Schäfer Coaching & Event GmbH and/or Silke Schäfer Online GmbH. We are also entitled to take legal proceedings against you at your domicile.
12. Final provisions
Should one or more of the individual provisions of these GTC be or become fully or partially invalid or unenforceable, the validity of the remaining provisions of these GTC or the purchase of our services shall not thereby be affected. In this case the parties will replace the invalid or unenforceable provision with a valid and enforceable provision which best corresponds to the intended economic purpose of the provision to be replaced. The same applies should these GTC contain any regulatory gaps.
Communications to the email address entered during registration or saved in the customer account shall be considered as legally delivered.
You relinquish the right to offset possible claims against us.
We reserve the right to change these GTC at any time. Changes will be made available on our website and take effect when they are posted on the website.
